YAKIMA, Wash. -- A barista accused of baring too much was found not guilty Friday but jurors decided her boss, the owner of Dream Girls, violated the city’s indecent exposure ordinance by approving the scanty outfit.
After hearing closing arguments earlier in the day, a jury of six convicted coffee shop owner Cheryl Clark, who faces up to 90 days in jail and fines of up to $1,000.
Clark said she plans to appeal.
Jurors deliberated for a total of about three hours, first handing down Clark’s verdict before returning to decide the case against barista Alyssa Hernandez. After she was found innocent, tears welled up in Clark’s eyes.
"I care about her," Clark said outside the courtroom. "We knew that she wasn’t guilty the entire time. I’m just elated. It’s over for her."
Both women were charged with violating the city’s indecent exposure ordinance, crafted by the City Council in 2009 in reaction to complaints that coffee stands with scantily dressed baristas were popping up all over town.
Police say that Hernandez was revealing too much while working at the stand one night more than a year ago. But she said her attire did not violate the ordinance.
"I thought it was just a waste of time and I’m glad that it’s over," Hernandez said. "I was just doing my job and I’m was happy the jury saw it that way."
During arguments, prosecuting attorneys defined such terms as buttocks and buttocks cleavage, attempting to conclude how much can be exposed legally....
