Yes, assuming that the prison guard/employee is always the more powerful one (and therefore the aggressor) is based on an inherent double standard that traps women.

Yes perhaps to create provisions that considers possible coercion and blackmail in the situation.

No, doesn't this provide a precedent for more gender bias against women?

No, the ruling is meant to protect those who are disadvantaged and keep those who are in power in line. These prison employees are not incarcerated.

In the case of inmate Michael Murphey, it has become apparent that though the sexual misconduct began as a consensual relationship between the female prison guards and said inmate (which in itself is punishable)—there is a definite need to redefine who the violator or aggressor is in this situation.
