The couple were reportedly granted a divorce by the court of Nice a couple of years ago. However, the wife then sued for damages over their lack of a sex life during their 21 year marriage.
The case reached the highest court in the South of France, in Aix-en-Provence where the judge ruled that a husband and wife must have sex together. The man was fined under article 215 of the Civil code which states “the married couple are obliged to lead a communal life”.
According to the judge’s ruling, “A sexual relationship between husband and wife is the expression of affection they have for each other, and in this case it was absent. By getting married, couples agree to sharing their life and this clearly implies they will have sex with each other.”
The husband had claimed that his lack of attention to his wife was due to working to hard and health problems.
